I am getting an increasing number of calls from people who have been served with statutory demands by SRJ debt collectors
. These demands are often based upon debts from credit card companies bought in by SRJ debt collectors.
SRJ debt collectors as a debt purchaser will have paid a few pence in the pound for your debt. They then seek to recover their outlay as quickly as possible by placing pressure on a debtor to repay as soon as possible.

One tactic which they use is to serve a statutory demand upon a debtor. They do this by serving the demand by post on the debtor.

It is imperative not to ignore a statutory demand. You have only 18 days to apply to set aside the demand, and after 21 days the demand can be followed by a bankruptcy petition.

Ordinarily a demand should be personally served. It is my personal belief that the demand is being used as a debt collection tactic and not for bankruptcy purposes as the demands that I have come across have only been served by post and so couldn't really be relied upon to base a bankruptcy petition. However, it should never be assumed that a demand will not be followed by a petition.

I deal with these demands by placing an onus on the creditor to prove that they have all the paperwork they need to prove the debt in full. I have many successes in getting companies who serve statutory demands to confirm that they will not take any action on them after receiving letters and requests from me.
